HomeMy WebLinkAboutBZA Resolution 154-323 - (901 Hermosa Ave)RESOLUTION B.Z.A. 154-323 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 901 HERMOSA AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on May 7, 1979, in the Council Chambers of the City Hall, considered the request of Mr. Kenneth L. Gray for permission to operate a wholesale business in conjunction with his warehousing operation, on property known as Lots 25, 26, 27, Block 10, Hennosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the proposed wholesale use is, in the Hermosa Beach Zoning Code, allowed in the Manufacturi ng Zone only; that the building was built before 1936 and does not provide for any parking or loading space on the property; and WHEREAS, at said public hearing, the applicant stated that he was applying for a wholesale business license required by the State Board of Equalization for selling to people without charging a state sales tax and that they require zoning approval from the City before issuing the license; that his wholesale business would occupy 1/3 of the building; that there is a loading door which would be used for the wholesale busi- ness; that his business would eventually include mail order; and WHEREAS, at said public hearing,_a letter was received from a neighboring property owner opposing the variance request based on traffic problems in the alley; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is not justified for the following reasons: There are no exceptional circumstances to justify the business being located in the C-2 zone; that it could be materially detrimental to the properties in the same vicinity because of the potential traffic problem; that it is not a property right possessed by other prop- erty in the same vicinity and zone; and the operation would not be in conformity with the general plan; NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby deny the variance request by the following vote: Ayes: Comms. Beard, Debellis, Chmn. Ebey Noes: Comm. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on June 4, 1979 in the Council Chambers of the City Hall,.considered the request of Mr. Robert Chitwood for per- mission to serve beer in conjunction with the operation of a billiard game parlour on property known as part of Lot 7, Block 83, 2nd Addi- tion to Hermosa Beach Tract; and WHEREAS, at said public hearing, the Board considered the proposed service of beer to be in conflict with the adjacent residential neighborhood and the shopping center usage; and WHEREAS, the Board considers the, ·proposed usage not to reflect the highest and best use for this location; NOW, THEREFORE, BE IT RESOLVED that the Board of Zoning Adjustments of the City of Hermosa Beach does hereby deny the request for condi- tional use permit to serve beer in conjunction with a billiard parlour at 1115 Aviation Boulevard. VOTE: AYES: Comms. Beard, Moore, Walker NOES: Comms. Merrill, Vice Chmn. Cummings ABSENT: Comms. DeBellis, Chmn.
