HomeMy WebLinkAboutBZA Resolution 154-334 - (2531 Myrtle Ave)RESOLUTION B.Z.A. 154-334 l ll A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DENYING A VARIANCE ON PROPERTY LOCATED 2 IIAT 2531 MYRTLE AVENUE, HERMOSA BEACH, CALIFORNIA. 3 WHEREAS, the Board of Zoning Adjustments of the City of 41 1Hermosa Beach, at a public hearing held on July 16, 1979, in the 5 11City Hall Council Chambers, considered the request of J.U. Invest- 6 11ments for permission to construct a 3 story duplex, 38 ft. high, 7 in lieu of the maximum allowed 2 stories, 35 ft. high, on property 8 legally described as Lot 5, Block 110, Shakespeare Tract; 9 WHEREAS, at said public hearing, the following facts 10 were presented for consideration: that in this project, the 11 garage is considered a basement ; but because the loft exceeds the 12 95 sq. ft., it is considered a third story and that 280 sq. ft. is 13 proposed for the loft and that the floor area below could be 14 rearranged but noted the project still exceeds the height limit 15,,by 3 ft.; 16 WHEREAS , at said public hearing , the applicant's repre- 17 sentative stated that this project has single family plus rental 18 and parking and also noted that the loft area can remain as is by 19 changing the room below; 20 WHEREAS, at said public hearing, several residents spoke 2111 in opposition to this project due to height; 22 WHEREAS , after due consideration, it is the opinion of 23 the Board of Zoning Adjustments that the variance request is 24 denied for the following reasons: 25 1. That there are no exceptional or extraordinary circumstances o 2611conditions applicable to the property involved. 27 2. That such variance is not necessary for the preservation and 28 enjoyment of a substantial property right possessed by other r ll lproperty in the same vicinity and zone. 2 113. That the granting cif such vari~nce will be materially 3l ldetrimental to the public welfare or injurious to the property or 4l limprovements in such vicinity and zone in which the property is 5 ll located. 6 NOW, THEREFORE, BE IT RESOLVED that the in view of the 7l labove findings of fact, the Board of Zoning Adjustments of the 8I ICity of Hermosa Beach, California, does hereby deny the variance 91 lby the following vote: 10 AYES: Comms . Cummings, Moore, Walker, Chmn ,, . Ebey None NOES: 11 ABSENT: Comms.
