A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH
DENYING A REQUEST FOR NONCONFORMING SIDEYARD AND GRANTING A REQUEST FOR A 19
FT. GARAGE DEPTH ON PROPERTY LOCATED AT 1712 PROSPECT AVENUE, HERMOSA BEACH,
CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on October 1, 1979, in the Counicil Chambers of the City Hall, considered
the request of Mr. and Mrs. Paul Matthies for permission to add a second unit behind
and over an existing two-car garage; variance being required because the existing
garage is 3 ft. from the side property line with an over 40% addition and the existing
garage depth is 19 ft. in lieu of the 20 ft. required, on property known as Lot 7,
Angela Heights Tract; and
WHEREAS, at said public hearing, the applicants stated the variance is necessary in
order to build a second unit without rebuilding the existing garage; that the project
is within the General Plan density designation; and
WHEREAS, at said public hearing, one resident of the area spoke in opposition to the
request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the request for a 19 ft. garage depth is justified, subject to a deed restriction
on the second unit, for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the nonconformity in the existing
garage is considered by the Board to be exceptionally small.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because similar exceptionally
small deviations are customarily granted.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vicinity
and zone in which the property is located because the granting of such a variance
would be an improvement of the lot.
4. That the granting of such variance will not adversely affect the comprehen-
sive General Plan because the area is zoned for R-2, which permits construction
of two units per lot.
AND, FURTHER, after due consideration, it is the opinion of the Board of Zoning Adjust-
ments that the request for a nonconforming 3 ft. sideyard is not justified for the
following reasons:
1. Because the Board feels the garage, being an accessory structure rather
than a main building, should not be included within the customary granting
of sideyard variances.
2. Because the applicant is not being denied a substantial property right.
NOW~ THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby deny the sideyard variance and grant the garage depth
request by the following vote:
AYES: Comms. Currnnings, Merrill, Walker, Chmn. Ebey
NOES: Comm. Moore
ABSENT: Co1T111s. Beard, DeBellis
