HomeMy WebLinkAboutBZA Resolution 154-262 - (1830 Hillcrest Dr)RESOLUTION B.Z.A. 154-262 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 1830 HILLCREST DRIVE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at public hear- ings held on December 19, 1977 and January 16, 1978, in the Council Chambers of the City Hall, considered the request of Mr. Frank Oliver and Ms. Jan Young for permission to maintain a 6 ft. high fence to property line within the front yard setback, on prop- erty known as Lot 16, Tract 2548; and WHEREAS, at said public hearings, the applicants stated that their front windows are 6 ft. tall and 8 ft. wide starting 19 inches above the ground and, therefore, a 3 ft. high fence would not allow for any privacy; that he built the fence about 1½ years ago and was not, at that time, aware of the need for a permit; and showed pictures of 87 other properties in Hermosa Beach with similar setback problems for their fences; and WHEREAS, at said public hearings, four people appeared to speak in favor to the request, a petition signed by 20 residents and four additional letters were presented in favor of the request; and WHEREAS, at said public hearings, two people appeared to speak in opposition to the request, and a petition signed by 47 people was submitted in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is not justified because they cannot meet findings No. 1 or No. 3 as follows: 1. There are no exceptional or extraordinary circumstances or conditions applicable to the property involved. 3. The granting of the variance may be detri'mental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is located. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby deny the variance by the following vote: AYES: Comms. Simpson, Sims, Chmn. Cummings NOES: None ABSENT: Comm. Toth, Anderson ABSTAIN: Comm. Ebey, Beard CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-262 was adopted by the Board of Zoning Adjustments at a regular meeting held on the 16th day of January, 1978.
