HomeMy WebLinkAboutBZA Resolution 154-266 - (619 5th St),.,, RESOLUTION B.Z.A. 154-266 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 619 FIFTH STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at public hear- ings held on January 4 and January 16, 1978, in the Council Chambers of the City Hall, considered the request of Mr. Harry Staalberg for permission to maintain an overheight fence within the 4 ft. easterly sideyard setback, on property known as Lot 40, Dr. Dougherty's Hermosa Bayview Tract; and WHEREAS, at said public hearings, the following facts were presented for consideration; that there is an eight foot high gate extending across driveway to easterly property line which is supported by a pipe extending up and over to opposite corner of gate and is approximately 12 ft. high; to meet code requirements, the easterly 4 ft. of the gate would have to be cut to a height of 6 ft. and the pipe relocated 4 ft. to the west; the remainder of the gate is part of the buildable area of the lot and could be as high as a building would be allowed; and WHEREAS, at said public hearings;.the applicant stated that an existing garage was torn down and the garage door left as a gate and a new three-car garage was built in the back; that he has a sentry dog that bites and he needs the gate to prevent the dog from getting out; that the pipe is 12 ft. high to allow his .camper with boat on top to enter the driveway; and WHEREAS, at said public hearings, two residents of the area spoke in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is not justified for the following reasons: 1. That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved. 2. That this is not a 'property right possessed by other property in the same vicinity and zone. 3. That the granting of the variance may be detrimental to the public welfare in such vicinity and zone in which the property is located. NOW, THEREFORE, BE IT RESOLlVED, that in view of the above findfogs :.of fact, the Board of Zoning Adjustments does hereby deny the request by the following vote: AYES: Comms. Simpson, Sims, Chmn. Cummings NOES: None ABSENT : Comm. Toth, Anderson ABSTAIN: Comms. Ebey, Beard CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-266:was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 16th day of January, 1978.
