A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1429-1439 OCEAN DRIVE,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on February 6, 1978, in the Council Chambers of the City Hall, considered
the request of Mrs. Mae Goodman-Malamuth for permission to make structural alterations
to a building with nonconforming use, to convert the two second story units into one
unit, maintaining the existing three enclosed parking spaces and single unit on the
ground floor_,,on property known as Lot 16, Heffner-Fiorini-Allen tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the interiors of the building to be revised have been inspected, and it has been
ascertained that the ground floor unit requires minor modifications to electrical and
mechanical to meet :Housing Code standards; and
WHEREAS, at said public hearing, the applicant's representative stated that the two
buildings were constructed according to standards in effect about 30 years ago; that
they hope to reduce from four units to three units, of which he will occupy one, his
mother will occupy one, and the third will be rented; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because a structural alteration is
required in order to combine two units, reducing density, and coming into
closer conformity with the General Plan.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vic-
inity and zone, and denied to the property in question does not apply as
it has not been considered a property right to combine units and such a
request has not appeared before this Board prior to this time.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located because the Board has
evidence submitted by neighbors that there is no adverse effect, and there
will be no increase in density and no basic change to the outer envelope
of the building.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because it brings the property into close conformity.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the request by the following vote:
AV.ES: Comms. Anderson, Ebey, Simpson, Sims, Toth, Chmn. Cummings
NOES: None
ABSENT: Comm. Beard

Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 6th day of February, 1978.
