HomeMy WebLinkAboutBZA Resolution 154-269 - (260 31st St)RESOLUTION B.Z.A. 154-269 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 260 -31ST STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hear- ing held on March 6, 1978, in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Clyde Malone for approval to encroach into the front yard from the building to the front property line with a first story deck, a second story deck with supporting posts, and a roof extension, on property known as Lot 20, Block 116, Shakespeare Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that at the time this property was developed, it was zoned R-2 with a front setback requirement of 4 ft.; that one year ago the property was downzoned to R-1 with a front setback of 7 ft.; that if this variance is approved, the applicant must then obtain approval from the City Council for the encroachment over public right-of-way at the first floor, second floor and roof levels; and WHEREAS, at said public hearing, the applicant stated that there are other structures in the neighborhood extending to the property line including one now under construction, and there is one extending into city property; that he has a letter from the Building Department stating the existing front door is not per code, although legal, as it exits to the side yard with a four-foot drop outside the door; that the proposed addition would change the entrance to the front; and WHEREAS, at said public hearing, ntvone appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is not justified because the Board cannot make the four required findings; NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings, the Board of Zoning Adjustments does ·hereby deny the variance request by the following vote: AYES: Comm. Beard NOES: Comms. Anderson, Ebey ABSTAIN: Comm. Sims for reasons stated in minutes; Comm. Toth, because of questions of consistency of the project; Chmn. Cummings, for reasons given by Comm. Sims. ABSENT: Comm. Simpson CERTIFICATION I hereby certify that the foregoing Resolution B.Z.A. 154-269 was adopted by the Board of Zoning Adjustments at a regular meeting held on the 6th day of March, 1978.
