A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING TANDEM PARKING AND DENYING 72% LOT COVERAGE ON PROPERTY
LOCATED AT 833 AND 845 BARD STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on April 3, 1978, considered the request of Donald Haggerty, Gerald
Donavan, Jill Sulser for permission to be allowed tandem parking for residential
use off of a street, and to be allowed 72% lot coverage in lieu of maximum 65%, on
property known as Lots 3 and 4, Block 11T11 , Tract 2002; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the project represents 26 du/ac versus the maximum allowed by the General Plan
of 40 du/ac and the zoning is R-3; that the proposed project as shown on the plans
has an overall height of approximately 25 ft. at the maximum point, whereas the zon-
ing code allows a maximum height of 35 ft.; that the street in question is classified
as 11 local" with respect to traffic loading, which designation means a street not
designed for through traffic or traffic mobility; that the subject street is a dead-
end street as it stops at the city park; that the project fits the Coastal Zone crit-
eria; that the most restrictive of all requirements placed on this project is the
bulk construction limit of 1.5 times buildable area; and
WHEREAS, at said public hearing, the applicant's representative stated they have
planned on two-story development rather than three to conform to the neighborhood,
and they have planned in a way to meet Coastal Zone Commission criteria; that there
are some landscaped areas; that the building is designed to follow the slight slope
of the lot; and
WHEREAS, at said public hearing, two people spoke in opposition to the request due
to parking congestion in the area; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
. that the tandem parking portion of the request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because it is a limited-access street
and there is no rear access to the property.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because the street is clas-
sified as local, and it is a dead-end street stopping at the city park.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located because there is a potential
adverse impact to creating additional traffic on the street only if the city
is derelict in carrying out its responsibilities in using the additional right-
of way; however tandem parking will aid the property in maintaining conformity
with the other properties in the area as this is the only alternative to a
three-story building.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because the proposed dwelling unit per acre is in con-
formity with the General Plan.
AND, FURTHER, after due consideration, it is the opinion of the Board of Zoning Adjust-
ments that the 72% lot coverage is not justified for the following reasons:
1. That there are no exceptional or extraordinary circumstances or conditions

applicable to the property involved.
2. That such variance is not necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the same
vicinity and zone, and denied to the property in question as excessive
coverage is not considered a property right.
NOW, THEREFORE, BE IT RESOLVED, that ih view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant part one of the request and deny part two of
the request by the following vote:
AYES: Comms. Beard, Ebey, Simpson, Sims, Chmn. Cummings
NOES: None
ABSENT: Comm. Anderson
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-271 was adopted by the Board
of Zoning Adjustments at a regular meeting held on the 3rd day of April, 1978.
