HomeMy WebLinkAboutBZA Resolution 154-272 - (1021 Monterey Blvd)' 1 / RESOLUTION B.Z.A. 154-272 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1021 MONTEREY BOULEVARD, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on April 17, 1978, in the Council Chambers of the City Hall, considered the request of Mr. Larry Fisher for permission to make a 17 1 x 22 1 addition to the rear of an existing single family residence with a nonconforming one ft. (1 1 ) front yard setback, on property known as Lot 41, Tract 1068; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the required front setback for the block is three feet (3 1 ); and WHEREAS, at said public hearing, the applicant's representative stated that this is an existing single family residence previously converted from a duplex; that the proposed one-story addition is approximately 10 1 to 15 1 above street level; that this is only a request to add a bedroom and bath and that building a second unit is very unlikely; and WHEREAS, at said public hearing, no one appeared to speak in support of or opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional circumstances applicable to the property involved because at the time of original construction a one foot setback was allowable on Monterey as is evidenced by many other structures on Monterey also having one foot setbacks. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone because without variance, no modifications can be made to existing residence. 3. That the granting of such variance will not be materially detrimental to the public welfare because all new construction will comply with existing building codes as minimum standard requirements. 4. That the General Plan will not be affected except by the reduction of allowable density in the area since the property is zoned R-3 and · use will be R-1. AND, FURTHER, that the approval is granted subject to the following condition: 1. That a deed restriction be required indicating that the structure must meet all current code requirements in the event that modifica- tions are requested in the future. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact,. the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Ebey, Simpson, Sims, Chmn. Cummings NOES: Comm. Toth ABSENT: Co111T1s. Anderson, Beard CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-272 was adopted by the Board of Zoning Adjustments at a regular meeting held on the 17th day of April, 1978.
