HomeMy WebLinkAboutBZA Resolution 154-273 - (1115-1117 17th St)r" RESOLUTION B.Z.A. 154-273 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1115-1117 SEVENTEENTH STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on May 1, 1978, considered the request of Mr. and Mrs. Bill Gray for permission to make a second story addition to an existing duplex with nonconforming rear yard setback of 3 ft. in lieu of the 5 ft. required, on property known as the East 88.41 1 of Lot 6, Angela Heights Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the proposed project was first referred to the Planning Commission because of potential future use as an illegal apartment; that the Planning Commission approved the plan subject to a deed restriction limiting use to two units; that the submitted plans do not call out a name for the large room, but an open air room with no door is indicated; and WHEREAS, at said public hearing, the applicant stated that the application for variance was only to enlarge a small existing apartment, that no more land area would be covered and the variance would avoid a 2 ft. notch in the building; that there have been 49 similar variances approved since 1974; and WHEREAS, at said public hearing, no one appeared to speak in support of or opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified, subject to conditions, for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because strict application would only require a 2 ft. notch that would be unsightly and structurally undesirable. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because there are other properties in the same area and zone with nonconfor~ng setbacks. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicin- ity and zone in which the property is located because property will remain same footprint and that there are no objections from neighbors. 4. That the number of dwelling units will remain within the General Plan limitations. AND, FURTHER, that the variance is granted subject to the following conditions: 1. That the entry indicated could not be further partitioned and that access to the addition shall be from the existing entry only. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: AYES: Comms. Beard, Simpson, Sims, Toth, Chmn. Cummings NOES: Comm. Ebey ABSENT: Comm.
