RESOLUTION B.Z.A. 154-274
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH
GRANTING A VARIANCE ON PROPERTY LOCATED AT 30 SIXTH COURT, HERMOSA BEACH,
CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on May 1, 1978 in the Council Chambers of the City Hall, considered the
request of Shirley Smith Jones for pennission to repair and remodel an existing
duplex nonconforming as to use and parking requirements, on property known as the
north 50 ft. of Lot 18, Block 6, Hermosa Beach Tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the applicant does not propose to enlarge the building envelope; that there is
one nonconforming enclosed parking space usable for a compact car; and
WHEREAS, at said public hearing, the applicant's representative stated there are some
termite problems and work will only be remodeling and enlarging some windows struct-
urally; that the bedroom closet would be enlarged, all plumbing fixtures repaired
and upgrading electrical work; that the variance is required only for increasing
window sizes and cutting a door opening; and
WHEREAS, at said public hearing, a petition containing 29 signatures was submitted in
favor of the request and no one appeared to speak in opposition; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because while changes do not increase
floor area, variance is in keeping with the stated wishes of the City Council
in upgrading property wherever possible.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because the variance will
allow structural changes which will enhance the property through additional
light, air and interior access.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located as the changes are so minor
that they have no effect on surrounding property.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because no change in the number of dwelling units will
occur.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Conms. Beard, Simpson, Toth, Sims, Chmn. Curranings
NOES: Comm. Ebey
ABSENT: Comm. Anderson
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-274 was adopted by the Board of
Zoning Adjustments at a regular meeting held on the 1st day of May, 1978.
