HomeMy WebLinkAboutBZA Resolution 154-280 - (912 9th St)RESOLUTION B.Z.A. 154-280 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 912 NINTH STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on July 17, 1978, in the Council Chambers of the City Hall, considered the request of Mr. Robert W. Cengia for permission to add a second story to an existing single family residence, the roof height of said addition varying from 24 ft. to 32 ft., which is in exception to Section 401 (a) of the Zoning Code defining building height in the R-1 zone, on property known as Lot 11, Tract 5650; and WHEREAS, at said public hearing, the following facts were presented for consideration; that building height means a vertical distance measured from the existing grade of a lot, adjacent to the exterior walls, from any portion of the building site covered by the building to the uppermost point of the roof, parapet walls or railings; that when the grade has been lowered, said vertical distance shall be measured from the finished grade; and WHEREAS, at said public hearing, the applicant submitted a drawing of the area super- imposed on the plans for his building; he stated he feels that the problem is the grade; if his property was level he would have no problem meeting the 25 ft. height limit; and WHEREAS, at said public hearing, seven residents of the area spoke in opposition to the request; and WHEREAS, after due consideration. it is the opinion of the Board of Zoning Adjustments that the variance is not justified because testimony has shown it will be detrimental to surrounding properties; NOW, THEREFORE, BE IT RESOLVED, that in view of the above finding of fact, the Board of Zoning Adjustments does hereby deny the variance request by the following vote: AYES: Comms. Anderson, Ebey, Simpson, Sims, Chmn. Cummings NOES: None ABSENT: Cormts. Beard, Toth CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-280 was adopted by the Board of Zoning Adjustments at a regular meeting held on the 17th day of July, 1978.
