A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 919-921 14TH STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hennosa Beach, at a public
hearing held on August 7, 1978, in the Council Chambers of the City Hall, considered
the request of Messrs. K. B. Wright and Larry Rudy for pennission to retain a third
kitchen in a two-family dwelling, on property known as Lot 9, Block 1, Hermosa Knob
Hill Tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that since the building was built, there has been excavation, floors, closets, kitchen
facilities, fireplace and a water heater added, all without benefit of permits and
inspections; that the property is legal for two units only; and
WHEREAS, at said public hearing, the applicant stated he purchased the property as
it now stands; he said his request is to convert storage space on the ground floor
to recreational area; and
WHEREAS, at said public hearing, testimony was given by three residents of the area
that the area in question was indeed being rented since the applicants purchased the
property; and
WHEREAS, at said public hearing, a petition was submitted in opposition to the request
signed by 22 residents of the area; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance is not justified,,neither the applicants request nor the staff's
interpretation of the applicants• request, for the following reasons:
1. That there are no exceptional or extraordinary circumstances or conditions
to allow that type of construction without permit.
2. There is no evidence that there are any other properties wherein this
would allow a substantial property right enjoyed legally by anyone else
in the same vicinity and zone.
3. There has been testimony from quite a few people that this area being
in existance is detrimental to the surrounding property and property
owners; also, staff reported numerous construction conditions at the
property that were installed with almost gross negligence in regard to
the public safety and the safety of the people in the building.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby deny the variance request by the following vote:
AYES: Comms. Anderson, Ebey, Sims, Simpson, Chmn. Cummings
NOES: None
ABSENT: Comms. Beard, Toth
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-281 was adopted by the Board
of Zoning Adjustments at a regular meeting held on the 7th day of August, 1978.
