HomeMy WebLinkAboutBZA Resolution 154-283 - (2120 The Strand)RESOLUTION B.Z.A. 154-283 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING AN AMENDED VARIANCE REQUEST ON PROPERTY LOCATED AT 2120 STRAND, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 7, 1978, in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Walter Testa for permission to extend their existing living room and bedroom, said addition to encroach 3 ft. into their required 5 ft. front yard setback and to extend their north and south sideyard encroachments and would also increase their lot coverage from 68% to 74%, on property known as Lot 4, Block 22, Hermosa Beach Tract; and WHEREAS, at said public hearing, the applicants and their representative presented testimony that a number of the conditions requiring the variance were pre-existing and that they desire only to make their home more comfortable and expand their view of the Strand; that their existing house is small, narrow and limited in space; that the setbacks along the Strand vary a great deal; and WHEREAS, at said public hearing, a petition was submitted to the Board signed by 11 residents of the area in support of the project; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that there are no exceptional or extraordinary circumstances and, therefore, they are unable to make the required findings to allow the front yard setback encroachment; and WHEREAS, following discussion with the applicants, the Board agreed to an amended request allowing the new construction to involve only the southwest corner of the prop- erty such as to follow the existing south and west side of the building and to increase their lot coverage from the existing 68% to 71% for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because of the unusually small lot size and width. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because other similarly situated properties are built up ·=to the frontO:property line. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vic- inity and zone in which the property is located as evidenced by the petition containing signatures of the property owners in the vicinity, and as evidenced by the absence of testimony opposing the variance. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because the project has no effect on density. NOW, THEREFORE, BE IT RESOLVED, that in view of the above finding of fact, the Board of Zoning Adjustments does hereby grant the amended variance request by the following vote: AYES: Co11TI1s.
