A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 2510 STRAND, HERMOSA
BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on September 6, 1978, in the Council Chambers of the City Hall, consid-
ered the request of Double D Investment Company for permission to encroach 6 ft. with
one-story construction into a required front yard; to encroach with a stairway 6 ft.
10 in. further into the front yard than the 3 ft. allowed; and to increase lot cover-
age from the existing 66.6% to 69.3%, on property known as Lot 2, Block 26, Hermosa
Beach Tract; and
WHEREAS, at said public hearing, the applicant's representative stated that the house
is an old one; that they are attempting to make the existing deck more usable; that
the property is already over the code in lot coverage but the biggest thing they were
doing to increase the lot coverage was enlarging the garage to meet the minimum require-
ments of the City; that the applicant is willing to revise his plans and put the hot
tub on the ground; and
WHEREAS, at said public hearing, no one appeared to speak in support of or in opposi-
tion to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because (a) of the current setback the
stairway is necessary in order to get down to ground level without removing
part of the house (already existing structure); (b) the additional garage
depth brings the parking into conformance; (c) eave overhang necessary for
energy conservation and meets modern design standards.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because (a) the stair is
necessary because it gives access to the Strand; (b) the garage expansion is
necessary to relieve the substandard dimensions of the present garage.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
initv and zone in which the property is located because there is nothing
being added to the property that would be detrimental to surrounding properties.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because while it is increasing lot coverage, it is making
usable parking space and making the lot more usable per the General Plan.
AND, FURTHER, the variance is granted subject to the following condition:
1. That the deck encroach no further than the existing which forces the
hot tub down into the front yard and in the front yard it can be no higher
than 30 11 above grade.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Comms. Beard, Ebey, Simpson, Chmn. Toth
NOES: None
ABSENT: Comms. Cummings, Debellis, Sims
