A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 3122 HERMOSA AVENUE,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on September 6, 1978, in the Council Chambers of the City Hall, considered
the request of A. John Berardo and John Kirkpatrick for permission to allow a 22 ft.
turning radius instead of the required 23 ft. turning radius to their tandem garage,
and to allow stairs to encroach into the required sideyard at the southwest corner
of the building, on property known as Lot 2, Block 104, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the stairway encroachment was very minor in nature and meets the intent of the
code in that the approximately 2½ feet between stair and property line allows fire
department access; and
WHEREAS, at said public hearing, the applicant that this is an existing duplex and
there will be no change in use, they just desire to remodel and enlarge the existing;
that they are enlarging the garages; that the 22 ft. turning radius has existed for
over 30 years and has proved to be no problem; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because conditions have been in existence
since the original construction over 30 years ago and the expense to the
applicant to change conditions would be excessive and a hardship of great
difficulty. In addition there will be two additional parking spaces.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because it would bring the
building up to code and allow the building to be R-2, standard use along that
area.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located because it does not directly
affect surrounding properties, but adds to the area by upgrading existing
building.
4. That the granting of such variance will not adversely affect the comprehen-
sive General Plan because it is in compliance with the General Plan usage.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Comms. Beard, Ebey, Simpson, Chmn. Toth
NOES: None
ABSENT: Corrms. Cummings, Debellis, Sims

I hereby certify that the foregoing Resolution BZA 154-285 was adopted by the Board
of Zoning Adjustments at a regular meeting held on the 6th day of September, 1978.
