HomeMy WebLinkAboutBZA Resolution 154-286 - (914 3rd St)RESOLUTION B.Z.A. 154-286 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 914 THIRD STREET, HER- MOSA BEACH, CALIFORNIA. . WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on September 6, 1978, in the Council Chambers of the City Hall, consid- ered the request of Mr. and Mrs. William Glider for permission to add more than 40% to an existing single family dwelling with nonconforming sideyard, on property known as Lot 28 and E. 15 1 of Lot 26, Mission Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the existing residence is only 906 square feet and the proposed addition is 570 square feet; and WHEREAS, at said public hearing, the applicant stated he was amenable to providing an interior connection from the existing building to the addition and would, in addi- tion, sign a deed restriction; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified, subject to conditions, for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the existiog sideyards have been there since construction in 1925; it is a small house and a needed addition. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because nonconforming side- yards are common throughout the City; and these are minor nonconformities of etisting lines. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vic- inity and zone in which the property is located because construction to improve the property will not be detrimental or injurious to surrounding properties. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because the construction is well below the maximum of the requirements of the General Plan. AND, FURTHER, that such variance is granted subject to the following conditions: 1. That the plans be revised to provide an interior connection from the existing building to addition. 2. That a deed restriction be provided limiting the use of the property to a single family dwelling. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: AYES: Comms.
