A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 843 EIGHTH PLACE, HER-
MOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on September 6, 1978, in the Council Chambers of the City Hall, consid-
ered the request of Mr. and Mrs. James Bates for permission to be allowed to encroach
into the required 5 ft. rear yard setback with deck, hot tub, and with existing patio
roof; to build an attached garage within 3 ft. of a side lot line in lieu of the
required 5 ft.; and to retain an existing 4 ft. easterly sideyard while adding more
than 40% to the existing single family dwelling, on property known as Lot 52, Tract
8386; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the lot coverage (35%) existing, proposed (54%) includes assumed dimensions of
the patio which was covered without apparent building permit, and also includes all
proposed decks raised more than 2½ feet above grade; and
WHEREAS, at said public hearing, the applicant stated he intended to remove the fiber-
glass cover over the patio and replace it with a grapestake type of cover so rain
water could filter through to back patio; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because of the pitch of the hill behind
and the previous owners encroachments, it would be a considerable hardship
to bring the easterly sideyard into conformity.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because in the rear yard it
will allow the enjoyment of open space which would not otherwise be provided
in usable form.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located because construction does not
interfere with the surrounding properties and the people in the immediate
vicinity have signed a petition in favor.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because the development is well within the General Plan. -
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Comms. Beard, Ebey, Simpson, Chmn. Toth
NOES: None
ABSENT: Comms. Cummings, Debellis, Sims

I hereby certify that the foregoing Resolution BZA 154-287 was adopted by the Board
of Zoning Adjustments at a regular meeting held on the 6th day of September, 1978.
