HomeMy WebLinkAboutBZA Resolution 154-288 - (1781 Valley Park Ave)RESOLUTION B.Z.A. 154-288 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1781 VALLEY PARK AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hear- ing held on September 6, 1978, in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Bernard Kersulis for permission to add more than 40% to an exist- ing single family residence with nonconfonning front and side yards; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the plans now before the Board have several zoning corrections not covered by the variance which will have to be corrected prior to permit issuance, as follows: Stairs in five foot sideyard must return to grade and must be a "solid concrete stair landing and stairs on grade"; the forced air unit shown on the floor plan will have to clear the side property line by three feet; and the plans m~st be adjusted so that both parking stalls in the garage are the required depth; and WHEREAS, at said public hearing, the applicant presented the Board with a petition signed by 13 neighbors in s~pport of the request; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because nonconformities were in existence with original con- struction and the prevailing nonconformities are not increased. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed byrother property in the same vicinity and zone, and denied to the property in question because everyone on the street signed the petition in favor of the construction and he has similar use of his property as his neighbors. By improving and increasing the house size he is enjoying the same rights as his neighbors. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because virtually all of the adjacent homeowners signed the petition in favor of the improvements. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because the building is entirely within the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: AYES: Comms. Beard, Ebey, Simpson, Chmn. Toth NOES: None ABSENT: Convns. Cummings, DeBellis, Sims CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-288 was adopted by the Board of Zoning Adjustments at a regular meeting held on the 6th day of September, 1978.
