HomeMy WebLinkAboutBZA Resolution 154-290 - (140 Hermosa Ave),r RESOLUTION B.Z.A. 154-290 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 140 HERMOSA AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on October 2, 1978, in the Council Chambers of the City Hall, considered the request of Mr. D. A. Sowers for permission to position a moved~on house so that the rear yard conforms and the front yard conforms to the required setback, with the exception of an encroachment at second story level of 2 ft. into the required 5 ft. front setback; to allow a stair landing at the 3rd floor level to encroach 1 foot into the required sideyard of 3 feet; to alllow the entrance stair to be constructed with landing 9 feet above grade and without stairs returning to grade at rear; and to allow a buttress to project within 2 feet of a lot line in lieu of the required 30 inches, on property known as the westerly 58 ft. of Lot 7, Tract 1122; and WHEREAS, at said public hearing, the applicant said that he requests these variances in order to attempt to preserve the existing architectural features of the building; that since the lot does not go street to street, it would be difficult to have a return stairwell to the front door; that the encroachments are at second story level and since it is not a deck, there is no danger of things dropping onto people below; that if the encroaching archway on the south side of the building were removed then the one on the north side would also have to be removed for appearance sake; that he is simply trying to preserve an old, uniquely beautiful house; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because of exceptional and unique geometry and an extra- ordinary method of conserving existing housing stock. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because the approved setbacks and sideyards are frequent within the area. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the overhangs improve the facial effects of the building and are not injurious to surrounding properties. 4. That the granting of suchvariance will not adversely affect the comprehensive General Plan because it is consistent with the zoning due to lot size and general plan as a single family dwelling. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: AYES: Comms. Beard, Ebey, Simpson, Sims, Toth, Chmn. Cunmings NOES: Comm.
