HomeMy WebLinkAboutBZA Resolution 154-292 - (629 24th Pl)RESOLUTION B.Z~A. 154-292 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 629 -24th PLACE, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on October 2, 1978, in the Council Chambers of the City Hall, considered the request of Richard and Antoinette Greer for permission to add over 40% to an existing single family dwelling with nonconforming westerly side yard, on property known as Lots 23 and 24, Block 3, Hermosa View Tract #2; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the previous proposed project at this address was approved by the Board of Zon- ing Adjustments and reversed by City Council after an appeal hearing which involved extensive testimony from neighbors regarding blocking of view; that the neighbors and applicant have met and agreed upon the compromise of constructing the second story addition in a location and shape which has as little effect as practicable upon views enjoyed by adjacent property owners; and WHEREAS, at said public hearing, the applicant's representative stated that the addition has been moved forward to refrain from blocking the neighbors' view and the current plans have a lower profile; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional and extraordinary circumstances or conditions applicable to the property involved because otherwise he could not build the addition without tearing down the entire west wall of his house, the Council and Planning Commission both have expressed a desire that we try, wherever possible, not to penalize the existing properties because of changes in the Zoning Code. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because the Board has granted similar variances on exten- sions of homes with nonconforming yards, and there are many others in the neighborhood. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because there is no evidence that there is any detrimental effect caused by this nonconforming sideyard. Although there may be some effects caused by the overall building, this nonconforming sideyard in and about itself does not have any direct effect on surrounding properties. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because the building is within the number of units required by the General Pl an. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: AYES: Comms. Beard, Debellis, Ebey, Simpson, Sims, Toth, Chmn. Cummings NOES: None ABSENT: None CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-292 was adopted by the Board of Zoning Adjustments at a regular meeting held on the 2nd day of October, 1978.
