A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 409 -31ST STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on October 2, 1978, in the Council Chambers of the City Hall, considered
the request of Mr. and Mrs. Bradley G. Fritzel for permission to add more than 40%
to an existing single family dwelling with a 51611 existing front yard setback in lieu
of the 7' required; also to be allowed a 20.5 turning radius in lieu of the required
23 ft., on property known as Lot 5, Block 124, Shakespeare Tract; and
WHEREAS, at said public hearing, the applicant stated that moving the front setback
would necessitate moving the entire house back which is not feasible; that many of
the houses on the block have setbacks that are smaller than subject property; that
he is enlarging the garage to meet new standards; and
WHEREAS, a petition signed by three of the immediately adjacent neighbors was received
in support of the request and no one appeared to speak in opposition; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the request is justified, subject to provisions, for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved because there is no other way to add to this house without
substantial demolition of the existing structure, and the variance is minor in nature
and a technicality.
2. That such variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone, and denied
to the property in question because many other owners in the vicinity are in the same
position.
3. That the granting of such variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in such vicinity and zone in which
the property is located because the addition in and of itself has not effect on the sur-
rounding properties by the granting of this variance ..
4. That the granting of such variance will not adversely affect the comprehensive
General Plan because the number of dwelling units per acre has not increased and this
property is in conformity with the General Plan.
AND, FURTHER, that approval is subject to the following condition:
1. That a 20 ft. garage door be provided and if possible to raise the fresh air unit
above ground so that they can have the clearance; if not possible, then to allow a
6 inch encroachment into the required garage space.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Co1TDTis. Beard, Ebey, DeBellis, Simpson, Sims, Toth, Chmn. Cummings
NOES: None
ABSENT: None
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-294 was adopted by the Board of
Zoning Adjustments at a regular meeting held on the 2nd day of October, 1978.
