HomeMy WebLinkAboutBZA Resolution 154-296 - (441 31st St)RESOLUTION B.Z.A. 154-296 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 441 -31ST STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on November 8, 1978, in the Council Chambers of the City Hall, considered the request of Mr. Michael Sanders, etal, for permission to add more than 40% to an existing single family dwelling with nonconforming front yard setback, in exception to Section 1309 of the Zoning Code, on property known as Lot 21, Block 124, Shakespeare Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that other properties in the same vicinity have less than this 6 foot setback due to the fact that this block had been zoned R-2 and was rezoned to R-1 at the request of the property owners (original setback requirement was 5 ft., new setback required is 7 ft.); and WHEREAS, at said public hearing, the applicant explained it was his desire to improve the front of his home; he also stated he would accept a condition of a deed restriction on the property; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance is justified, subject to conditions, for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because residents voluntarily rezoned themselves to R-1 which resulted in nonconformity. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because other homes in the area have similar front yard setbacks. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the requested variance does not affect sur- rounding properties. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because the addition has no effect on the General Plan. AND, ·FURTHER, that the variance is granted subject to the following condition: 1. That a deed restriction be provided limiting.the use of the property to a single family dwelling. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: AYES: Convns. Beard, DeBellis, Simpson, Chmn. Cunvnings NOES: None ABSENT: Comms.
