A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH
GRANTING A VARIANCE ON PROPERTY LOCATED AT 2500 STRAND, HERMOSA BEACH, CALIF-
ORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on November 8, 1978, in the Council Chambers of the City Hall, considered
the request of Mr. and Mrs. Dennis Seawright for permission to extend an existing
building which encroaches approximately 5 inches beyond the sideyard property line on
the walk-street side of a corner lot (exception to Section 1309 of the Zoning Code;
also to add to a detached double garage which extends slightly beyond the property
line, said addition to be a third parking space and to encroach to the walk street
property line, on property known as Lot 1, Block 26, Hermosa Beach Tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the variance can be given only for the proposed work within the property lines;
i.e., the City Council will have to review the portion encroaching over city property;
and
WHEREAS, at said public hearing, the applicant was present to answer questions from
the Board; and
WHEREAS, at said public hearing, a petition containing 59 signatures of neighboring
residents was submitted in support of the reque·st; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved because the setback encroachment is on a property line
on a dedicated walkway not a typical sideyard.
2. That such variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone, and
denied to the property in question because the majority of the garages on the
Strand properties when the garages face Hermosa Avenue are built to the property
line -most all of the others are up to 5% over.
3. That the granting of such variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and
zone in which the property is located because the project is not directly affecting
any adjacent private property and the principal encroachment is a porch and is an
existing encroachment.
4. That the granting of such variance will not adversely affect the comprehensive
General Plan because there is no change in the number of units.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Comms. Beard, DeBellis, Simpson, Chmn. Cummings
NOES: None
ABSENT: Comms. Ebey, Sims, Toth
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-297 was adopted by the Board of
Zoning Adjustments at a regular meeting held on the 8th day of November, 1978.
