A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 921 FIFTH STREET, HER-
MOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on November 8, 1978, in the Council Chambers of the City Hall, consid-
ered the request of Mr. Gerald W. Johnson for permission to add more than 40% to
an existing building with nonconforming sideyard and to continue the nonconfonning
sideyard with the new addition (exception to Section 1309 of the Zoning Code); also,
to be allowed a 16'311 garage width in lieu of the 17' required (exception to Section
1158 of the Zoning Code), on property known as East 40 ft. of Lots 5, 6, 7, Camino
Real Tract; and
WHEREAS, at said public hearing, the applicant stated he wishes to improve his
home for aesthetic reasons and the back area is very large and of no use the way
it is; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the
request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified, subject to conditions, for the following
reasons:
1. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved because the nonconforming interior garage wall will be
moved to the existing hallway, and further movement would encroach into the mini-
mum width of the hallway.
2. That such variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone, and
denied to the property in question because many properties throughout the city
have pre-existing nonconforming sideyards. Many others in the city were granted
smaller garage widths before the advent of the smaller cars.
3. That the granting of such variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and
zone in which the property is located because the variance does not directly
affect the adjacent property owners.
4. That the granting of such variance will not adversely affect the comprehensive
General Plan because the granting of the variance in itself does not have any
effect on the General Plan since the Board cannot take into consideration the
second unit.
AND, FURTHER, that-the variance is granted subject to the following condition:
1. That there be a deed restriction limiting the property to two single family
dwellings only.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Conms. Beard, Simpson, Chmn. Cummings
NOES: Comm. DeBellis
ABSENT: Comms. Ebey, Sims, Toth
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-298 was adopted by the Board
of Zoning Adjustments at a regular meeting held on the 8th day of November, 1978.
