HomeMy WebLinkAboutBZA Resolution 154-299 - (623 Monterey Blvd)RESOLUTION B.Z.A. 154-299 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 623 MONTEREY BOULEVARD, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hennosa Beach, at a public hearing held on November 8, 1978, in the Council Chambers of the City Hall, consid- ered the request of Mr. and Mrs. Joe Winslow for permission to add more than 40% to a building with nonconforming sideyards, and to maintain the existing nonconform- ing setback with the new construction; also to encroach with eaves closer than 3011 from property lines, on property known as Lot 4, Tract 864; and WHEREAS, at said public hearing, the following facts were presented for considera- tion; that the north eave is proposed to project to within 19" of the property line and the south eave to within 21 11 of the property line; that the maximum R-3 stand- ards are not being utilized, such as allowable building height; and WHEREAS, at said-'public hearing, the applicants stated that the proposed roof will be composition; that the eaves now overhang to a greater degree, but will be cut back to 911 from the fact of the building; and WHEREAS, at said public hearing, letters were submitted from 19 residents of the area in support of the project and three residents spoke in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the nonconforming sideyards are existing. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because it is within the R-3 zoning requirements to add a second story; and because various changes in building and zoning codes created nonconforming sideyards as one of the most common variances granted throughout the city. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vic- inity and zone in which the property is located because for residential con- struction, the sideyards are adequate for passage of fire equipment; and because the eaves will be cut back and plastered for fire safety. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because the project is far below the requirements and maintains low density use in a high density area. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does her.eby grant the variance by the following vote: AYES: CoJID'lls. Beard, DeBellis, Simpson, Chmn. Cummings NOES: None ABSENT: Comms.
