A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH APPROVING A CONDITIONAL USE PERMIT FOR LIVE ENTERTAINMENT AT AN
EXISTING MOVIE THEATER LOCATED AT 1229 HERMOSA AVENUE, HERMOSA BEACH,
CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on December 4, 1978, in the Council Chambers of the City Hall, considered
the request of Mr. Douglas Levine for live entertainment in the form of rock concerts
and plays at an existing movie theater; said live entertainment will include amplified
music; and
WHEREAS, at said public hearing, the commission heard testimony from the applicant
that he is now using ushers for crowd control after midnight shows; that he was agree-
able to hire police doormen if it became necessary; that the stage would be blocked
off except during rock concerts; and
WHEREAS, at said public hearing, one resident spoke in opposition to the request,
expressing concern about the crowd control in the parking lot following the shows;
and
WHEREAS, the Board found the proposed usage to be consistent with the zoning and the
General Plan for the area;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Zoning Adjustments of the City of
Hermosa Beach does hereby approve a Conditional Use Permit for live entertainment at
an existing movie theater subject to the following conditions:
1. That the use for live entertainment be limited to the proposed hours indicated
on the application, 7:30 p.m. to 11:30 p.m., two times per month and 12:00 mid-
night to 2:00 a.m. Friday and Saturday nights for the Rocky Horror Show, and
that any change would require the approval of the Board of Zoning Adjustments.
2. That the building shall be maintained free of fire and safety hazards as deter-
mined by City Fire Department and City Building Department. This permit shall
not be effective until present hazards, of which City has notified applicant in
writing, have been abated.
3. That if a police problem is found to exist (as determined by the Police Chief),
doormen may be required to be present during all operating hours. If the
police problem continues, the City shall have the option of installing two
police doormen at the expense of the owner of the business. Non-payment shall
be grounds for revocation of this conditional use permit.
4. Operator and owner shall be responsible for maintaining the area adjacent to
the theater in an orderly and neat manner, as well as being responsible for the
contol of any lines so as not to create a problem for pedestrians or motorists.
5. That this permit is subject to three month review.
