A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH
APPROVING A CONDITIONAL USE PERMIT FOR THE OFF-SALE OF BEER, WINE AND LIQUOR
IN CONJUNCTION WITH THE OPERATION OF A MINI-MARKET AND SERVICE STATION ON
PROPERTY LOCATED AT 1131 PACIFIC COAST HIGHWAY, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on December 4, 1978, in the Council Chambers of the City Hall, considered
the request of Mr. Michael Richardson for permission to allow the sale of beer, wine
and liquor in conjunction with the operation of a mini-market and service station at
1131 Pacific Coast Highway, legally described as Lot 38, Block 78, 2nd Addition to
Hermosa Beach Tract; and
WHEREAS, at said public hearing, the commission heard testimony from the applicant
that he is not establishing a new business, only moving his existing business a matter
of several blocks; he also submitted a petition in favor of the granting of his request
signed by approximately 400 persons; and
WHEREAS, at said public hearing, nine persons spoke in favor of the request and six
persons spoke in opposition and submitted a petition in opposition signed by 49 persons;
and
WHEREAS, the Board found the proposed usage to be consistent with the zoning and the
General Plan for the area;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Zoning Adjustments of Hermosa Beach
does hereby approve a Conditional Use Permit for off-sale of beer, wine and liquor in
conjunction with the operation of a mini-market and service station subject to the
following conditions:
1. That the hours of beer, wine and liquor sales be limited to 9:00 a.m. to 1:00 a.m.
Any change in hours would necessitate permission py the Board of Zoning Adjustments.
2. That no alcoholic beverages may be opened or consumed on the premises.
3. Provision of at least one litter bin adjacent to the store operation.
4. Sales will not be made outside the shop; there will be no drive through direct car
service by the shop; purchases will have to leave an automobile to make any beer,
wine or liquor purchase.
5. Subject to three-month review.
6. Layout of parking and service areas subject to approval of Building Director.
