HomeMy WebLinkAboutBZA Resolution 154-220 - (221 31st St)RESOLUTION B.Z.A. 154-220 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 221 -31ST STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on January 17, 1977, in the Council Chambers of the City Hall, consid- ered the request of Mr. John A. Meyer for permission to be allowed to construct more than 40% gross floor area to an existing duplex with nonconforming yards and provide a front setback and usable open space less than that required under the R-1 standards, on property known as lot 7, Block 117, Shakespeare Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the project involves changirlg a duplex to a single family residence; that the westerly garage wall creates the nonconforming sideyard condition, and the past zone change increases the setback and open space requirements; and WHEREAS, at said public hearing, the applicant stated that the original plans were drawn before the zone change became effective and were changed to bring the height down to 25'; that there is considerable open space in front although it is city prop- erty; that the sideyards and balconies are planned to be usable open space; and that the columns and balcony extending into the front setback are not walls but are open in appearance; that it does not project further forward than other houses on the street; that he does have a Coastal Commission permit; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified as shown on the submitted plans for the follow- ing reasons: 1. That there are exceptional or extraordinary circumstances or condi- tions applicable to the property involved because it is the only exist- ing lot with open space in front for development and setback to R-1 standards would make it out of phase with the rest of the buildings on the street. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicin- ity and zone, and denied to the property in question because setbacks of the other buildings reflect R-2 standards. 3. That the granting of such variance-will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it meets the setbacks and heights of existing dwellings. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because it lowers the dwelling units per acre and makes a nonconforming duplex into a single residence. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the request by the following vote: AYES: Comms. Cummings, Schutz, Toth, Chmn. Sims NOES: Comm. Ebey ABSENT: Comms.
