RESOLUTION B.Z.A. 154-221
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 1049-1051 THIRD STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on February 7, 1977, in the Council Chambers of the City Hall, consid-
ered the request of Mr. Joseph S. Jeffries for permission to construct an addition
(approximately 456 sq. ft.) at the second floor over an existing garage to be used
as a family room. (Exception to Section 1301, H. B. Zoning Code, duplex in R-1
zone -nonconforming,) on property known as Lot 65, Mission Tract; and
WHEREAS, at said public hearing, the following facts were presented for considera-
tion; that the addition would not increase the existing density of 30 du/ac, and
that the increased lot coverage is caused by a balcony; and
WHEREAS, at said public hearing, the applicant indicated he had no further informa-
tion to add in support of his request; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is not justified for the following reasons:
1. That no exceptional circumstances have been demonstrated;
2. That it has not been demonstrated that this would be necessary for
the enjoyment of a substantial property right possessed by other
property in the same vicinity and zone and denied to the property
in question.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby deny the variance request by the following vote:
AYES: Comms. Beard, Collins, Cummings, Ebey, Toth, Chmn. Sims
NOES: None
ABSENT: Comm. Schutz
CERTIFICATION
I hereby certify that the foregoing Resolution B.Z.A. 154-221 was adopted by the
Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held
on the 7th ~f March, 1977.
