A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE FOR OVER 40% ADDITION WITH NONCONFORMING YARDS,
TO EXCEED ALLOWABLE LOT COVERAGE, NONCONFORMING USABLE OPEN SPACE AND
AND INADEQUATE TURNING RADIUS ON PROPERTY LOCATED AT 301 -31ST STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at public
hearings held on February 7-and March 7, 1977, in the Council Chambers, City Hall,
considered the request of Mr. and Mrs. Peter Gerrard for permission to be allowed
to add more than 40% gross floor area to an existing single family dwelling with
nonconforming yards and to provide usable open space in roof decks rather than yards
at grade; to exceed 65% allowable lot coverage and provide less than the required
turning radius with modified parking design standards, on property known as Lot 21,
Block 117, Shakespeare Tract; and
WHEREAS, at the February 7 public hearing, the applicant and the Board discussed
possible revisions to the proposed plans to allow for an additional parking space
and the hearing was continued to allow applicant to submit revised plans; and
WHEREAS, at the March 7 public hearing, the applicant submitted revised plans allow-
ing for an additional parking space and, at said hearing, further modified the plans
to meet building code requirements; and
WHEREAS, at said public hearings, letters were submitted from four residents of the
area and one resident appeared to speak in favor of the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust-
ments that the variance r~quest as modified is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances and conditions
applicable to the property involved because strict conformance to the code
would impose an undue hardship on the applicant.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because the zone designation
was recently changed from R-2 to R-1.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located because the variances granted
uphold the intent of the building code.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because the variances granted uphold the intent of the
General Plan.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request with changes as indicated
in the addendum to the variance dated February 24 and on the modified drawing labeled
Exhibit 11A11 , by the following vote:
AYES: Comms. Cummings, Ebey, Schutz, Chmn. Sims
NOES: None
ABSENT: Comms. Beard, Collins, Toth
CERTIFICATION
I hereby certify that the foregoing Resolution B.Z.A. !54-222 was adopted by the Board
of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the
2nd day of May, 1977.
