A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE FOR OVER 40% ADDITION TO EXISTING DWELLING AND
TO ALLOW AN ENCROACHMENT INTO REQUIRED FRONT YARD SETBACK ON PROPERTY
LOCATED AT 704 LOMA DRIVE, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on March 7, 1977, in the Council Chambers of the City Hall, considered
the request of Mr. and Mrs. Charles Hubbard for permission to add more than 40% to
an existing single family dwelling with nonconforming northerly sideyard and to
provide a 3 ft. front yard setback in lieu of the required 5 ft. setback, on prop-
erty known as Lot 1, Block 11 H", Tract 1686; and
WHEREAS, at said public hearing, the applicant stated that the lot is small and
they need space for a normal standard of living; that they are adding a two-car
garage, utility room and bathroom; and
WHEREAS, at said public hearing, the following facts were presented for considera-
tion; that the front yard encroachment of 2 ft. is necessary to provide the needed
garage depth; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the
request; and
WHEREAS, ,after due consideration, it is the opinion of the Board of Zoning Adjust-
ments that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the encroachment is necessary in
order to provide a desirable two-car garage.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because there are other prop-
erties in the area that have that same setback.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located because they are still pro-
viding a 3 ft. front setback which is consistent with surrounding properties.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because the addition is not creating any additional units.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Corrms. Ebey, Schutz, Chmn. Sims
NOES: Comm. Cummings
ABSENT: Comms. Beard, Collins, Toth
