A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE FOR FRONT YARD ENCROACHMENT ON PROPERTY LOCATED
AT 317 -28TH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on March 7, 1977 in the Council Chambers of the City Hall, considered
the request of Mr. Tom Griswold for permission to construct an upper deck, lower
porch and stairs encroaching into the required 5 ft. front yard setback to the
property line, on property known as Lot 25, Block 114, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented for considera-
tion; that the existing building is located 3 ft. from front property line due to
an earlier variance granted at time of construction; that the redwood fence shown
on plans located on city property would have to be approved by the City Engineer;
and
WHEREAS, at said public hearing, the applicant presented photographs of his prop-
erty and adjacent properties showing other properties built to property line and
added that he would not be willing to seal off the side entrance as he believes it
necessary to have two exits from a building; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the
request; and
WHEREAS, after due consideration, it -is the opinion of the Board of Zoning Adjust-
ments that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because other adjacent and nearby
properties have similar setback encroachments.
2. That such variance is necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same
vicinity and zone, and denied to the property in question because this
property has not been altered via setback encroachments as have others
as cited above.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located because it will allow
visual enhancement of the subject property in conformance with existing
improvements on adjacent and nearby properties.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because there will be no adverse impact thereon.
In addition, no units will be added.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the
Board of Zoning Adjustments does hereby grant the request by the following vote:
AYES: Comms. Curmnings, Ebey, Schutz, Chmn. Sims
NOES: None
ABSENT: Cormns. Beard, Collins, Toth

Board of Zoning Adjustments at a regular meeting held on May 2, 1977.
