HomeMy WebLinkAboutBZA Resolution 154-227 - (608 1st St)RESOLUTION B.Z.A~ 154-227 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE FOR PROPERTY LOCATED AT 608 FIRST STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at public hearings held on March 21 and May 2, 1977, in the Council Chambers, City Hall, con- sidered the request of Mr. Fred Brown for permission to erect a single family dwel- ling on an R-3 property with an existing oil well on the rear portion of the lot, on property known as Lot 153, Walter Ransom Co. 's Venable Place Tract; and WHEREAS, at said public hearings, the following facts were presented for considera- tion; that the request is in conflict with Section 1300 of the Zoning Code which states that "while a nonconforming use exists on any lot, no new use may be estab- lished thereon even though such other use would be a conforming use"; and WHEREAS, at said public hearings, the applicant's representative presented a letter from the attorney for the owner of the mineral rights and oil drilling apparatus indicating he had access rights from adjoining properties and was in a position to relinquish surface rights on the lot in question; that a buffer zone is planned of at least 50 ft. between the well and the proposed structure which would be more than required if the well was on an adjacent property; and WHEREAS, at said public hearings, one resident of the area spoke in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust- ments that the variance request is not justified for the following reasons: 1. That there appear to be no exceptional or extraordinary circumstances applicable to the property involved. 2. That there has been no evidence of similar property rights being pos- sessed by others in the same vicinity and zone. 3. Because closing off that land to access will increase the access traffic on neighboring lots. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby deny the variance request by the following vote: AYES: Comms. Beard, Cummings, Ebey, Schutz, Toth, Chmn. Sims NOES: None ABSENT: None ABSTAIN: Comm.
