RESOLUTION B.Z.A. 154-229
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE TO DISTANCE BETWEEN BUILDINGS ON PROPERTY
LOCATED AT 41 FOURTH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on April 18, 1977, in the Council Chambers ,~of the City Hall, consid-
ered the request of Mr. Gary Westendorf for permission to erect a four-car garage
with unit above on a lot with an existing single family dwelling, the garage por-
tion of proposed new structure to be 6 ft. from existing building in lieu of 8 ft.
required by Section 604 (3) of the Zoning Code; and
WHEREAS, at said public hearing, the following facts were presented for considera-
tion; that in order to build a second unit on the lot four offstreet parking spaces
must be provided; that the depth requirement for a tandem garage is 40 ft.; the
rear setback on alley at first floor level is 3 ft., leaving an area of six feet
between the existing and new buildings at first floor level; that the second floor
dwelling area of proposed structure will be approximately 15 ft. from existing
building; and
WHEREAS, at said public hearing, the applicant stated that he would be living in
the rear unit and would prefer two separate buildings; and
WHEREAS, at said public hearing, a resident of the area spoke in favor of the
request; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the
request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the varianc~ request is justified, subject to conditions, for the following reas-
ons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because due to a technicality in the way
the code is written, strict adherence to the code would create an unnecessary
hardship.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because other properties in
the area are built with similar distances between buildings. 3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located because usable open space
is still provided by the deck over the garage.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because the number of units is consistent with the
General Plan.
AND, FURTHER, that the variance is granted subject to the following condition:
1. That the open deck over the garage may not be enclosed for living space.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
