RESOLUTION B.Z.A. 154~230 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE TO REQUIRED SIDEYARD REQUIREMENTS FOR PARKING ON PROPERTY LOCATED AT 222 STRAND, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on May 2, 1977, in the Council Chambers of the City Hall, considered the request of Mr. Robert Diamond for permission to build a duplex with two-car detached garage and two open tandem parking spaces, the open parking spaces to encroach into the required sideyard on property known at Lot 4, Block 3, Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the applicant has submitted two proposals; exhibit 11 C11 shows a two-car garage separated by 7 ft. from the dwelling and located on the northerly property line with two tandem open parking spaces encroaching into the southerly sideyard to property line; exhibit 11D11 shows the two-car garage attached to the dwelling and maintaining the required 3 ft. northerly sideyard with the open parking spaces encroaching to property line on the southerly sideyard; and WHEREAS, at said public hearing, the applicant's architect stated that there are extraordinary circumstances because the present requirements of the city and the Coastal Commission, if met without a variance, would leave very little building space, about 600 sq. ft. on grade, and the house would resemble a tower; that, if granted, the variance would give them a great deal more scope for a different, better and more usable plan; and WHEREAS, at said public hearing, one neighboring resident spoke in favor of the request, and no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request with respect to exhibit 11 D11 is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because current parking and setback requirements make it extremely difficult to create adequate ground level living space on lots 30 ft. in width, which have R-2 usage, without the possibility of creating excessive canyons going the full length of each side of said lot. 2. That such variance is necessary for the preservation and enjoyment Of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property is question because a number of side- yard encroachments, several to accorrmodate the required parking, exist in the same vicinity and zone as the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because said variance does not directly affect surrounding properties. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because the creation of a duplex is in accordance with the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: ♦ ,. ,r PAGE TWO -RESOLUTION B.Z.A. 154-230 222 STRAND VOTE: AYES: Comms.
