HomeMy WebLinkAboutBZA Resolution 154-232 - (136 Hermosa Ave)\ RESOLUTION B.Z.A. 154-232 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 136 HERMOSA AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on May 16, 1977, in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Dennis Sowers for permission to make structural altera- tions to an existing duplex located in a C-1 zone, on property known as Lot 6, Tract 1122; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the applicants are proposing to remove the existing kitchen and service porch of the front unit of a duplex, and add a new entry and kitchen; that under the current C-1 zoning, residential usage is not permitted unless the lot is large enough for four residential units or unless the residential use is combined with a commercial use; therefore, the duplex on the lot is nonconforming; and WHEREAS, at said public.hearing, the applicant stated that they are adding approxi- mately 128 sq. ft. and removing 152 sq. ft., so they are actually reducing the square footage of living area; that it is encroaching on an adjoining lot and he has agreed to pay the taxes on that lot until the encroachment is removed; and the street is predominantly high density residential; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the property is located in a C-1 zone and is therefore nonconforming and not allowed structural altera- tions. 2. That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicin- ity and zone, and denied to the property in question because the 11 non-allow- ance11 of structural alterations prevents the -i•mprovement of the property through proper maintenance and rehabilitation in order to conserve the existing dwelling and most of the other property in the neighborhood is residential and therefore this is in keeping with the surrounding properties. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the proposed alterations will be an improvement to the vicinity and the majority of the property is presently residential rather than commercial. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because the General Plan shows residential high density and this request is consistent with the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance t>y the following vote: AYES: Comms.
