A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1001-1003 -17TH STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on June 6~ 1977, in the Council Chambers, City Hall, considered the
request of Mr. and Mrs. Richard Holmes for permission to install a 4 ft. high
chain link fence atop a 6 ft. high block wall along the easterly and northerly
property lines to prevent play ba 11 s from leaving property, on property known as
Lot 7, J.M. Floores Sub; and
WHEREAS, at said public hearing, the applicant stated he is constructing a paddle
tennis court to occupy one half of the yard space with the other half in planters
and trees, with the proposed fence to keep the balls in the yard; that the fence
will be green rubberized chain link which will allow air and light circulation
and will blend in with the trees; that the court will not be lighted; that there
will be no night play; and
WHEREAS, at said public hearing, letters were presented from three neighbors in
favor of the request and no one appeared to speak in opposition to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust-
ments that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because of the unique use of the prop-
erty as a paddle tennis court.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because there are other
people with unusual circumstances to whom the Board has granted overheight
fences.
3. That the granting of the variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located as it will be a chain link
fence, and testimony has been received from neighbors approving the fence.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because it does not involve an increase in density.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Comms. CutTD'nings, Ebey, Simpson, Toth, Chmn. Sims
NOES: None
ABSENT: Comms. Beard, Schutz
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-233 was adopted by the Board
of Zoning Adjustments of the City of Hermosa Beach at a regularly scheduled meeting
held on the 6th day of June, 1977.
