A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 56 EIGHTH STREET, HER-
MOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on June 20, 1977, in the Council Chambers of the City Hall, considered
the request of Mr. Robert B. Marks for permission to add a new bathroom to rear of
an existing residence, continuing a 2 ft. nonconforming sideyard for a distance of
six feet; and
WHEREAS, at said public hearing, the following facts were presented for considerati.on;
that the applicant proposes to add a 6 ft. x 14 ft. bathroom to an existing residence;
that said addition would continue the nonconforming sideyard a ;distance of 6 ft. and,
therefore, appears to be minor in nature; and
WHEREAS, at said public hearing, the applicant presented photographs of the property
and stated that the alterations would not increase the property from single family
dwelling usage; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because of the placement of the existing
building.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because other properties in
the same vicinity and zone have similar nonconforming yards.
3. That the granting of the variance will not be materially detrimental to
the public welfare or injurious to the property or improvements insuch vic-
inity and zone in which the property is located because the addition is minor
in nature and appears to meet the intent and purpose of the code.
4. That the granting of the variance will not adversely affect the compre-
hensive General Plan because it will not increase the number of dwelling units.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Conms. Beard, Ebey, Simpson, Toth, Chmn. Sims
NOES: None
ABSENT: Comms. Curmnings, Schutz
