HomeMy WebLinkAboutBZA Resolution 154-235 - (1940 Monterey Blvd)RESOLUTION B.Z.A~ 154-235 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1940 MONTEREY BOULEVARD, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on June 20, 1977, in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Robert Edwards to (1) construct an over 40% second story addition to an existing residence with nonconforming sideyards; and (2) to maintain the same nonconforming 2 ft. 6 in. sideyard for the new addition; and WHEREAS, at said public hearing, the following facts were presented for considera- tion; that the second story addition would have exterior stairs as well as an inter- ior stairway; and WHEREAS, at said public hearing, the applicant's representative stated that the object was to put all the bedrooms downstairs so that the living area would be up- stairs in order to take advantage of the ocean view; that it was not possible to remove the exterior stairway without totally redesigning the house; and WHEREAS, at said public hearing, the applicant stated that he understood what a deed restriction was and that he is willing to agree to such a condition; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified, subject to conditions, for the following reasons: 1. That there are exceptional or extraordinary d~ccirtls:tances or condi.tions applicable to the property involved because it would cause an unnecessary burden on the homeowners, as the setback is in existence. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because there are other properties in the vicinity with similar nonconforming setbacks. 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in th~ same vicinity and zone in which the property is located because it does not dir- ectly affect other dwellings. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because density is not increased. AND, FURTHER, that the variance is granted subject to the following condition: 1. That a deed restriction limiting the property to single family usage be required. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the request by the following vote: AYES: Comms. Beard, Ebey, Simpson, Toth, Chmn. Sims NOES: None ABSENT: Comms. Cummf ngs, Schutz CERT!
