A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 126 -30TH STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on July 5, 1977, in the Council Chambers of the City Hall, considered
the request of Mr. and Mrs. Allan T. White for permission to add more than 40% to
the rear of an existing single family residence with nonconforming front and side
yards; and to maintain nonconforming side yard for approximately 12 ft. of the new
addition; and to exceed the allowable lot coverage by approximately 1%, on property
known as Lot 8, Block 106, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented for considera-
tion; that the existing front yard setback is 11 611 in lieu of the 5' required; the
existing easterly side yard setback is 2'911 ; that the applicants wish to continue
said 2'911 setback for an additional 12', setting back to 3' for the garage addition;
that the 1% (22 sq. ft.) overage on lot coverage is due to the 41 deck on west side
of property; and
WHEREAS, at said public hearing, the applicant stated that the one-car garage will
be demolished and a two~car garage will be built; the residence will remain a three-
bedroom single family residence, and the extra room is a family room with no exter-
ior stairway; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the front setback of the house
is consistent with the front setbacks of property on both sides of 30th St.
The existing side yard setback on one side is only slightly under the required
three ( 3) feet -only three inches ( 311 ) nonconf arming.
2. That the variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because this house is a very
small single family residence situated on a lot zoned R-2i Adjacent. prpperty
is multi-family in use; an existing one-car garage would be upgraded to a two-
car garage; a new bedroom and bath would be added to make a reasonably-sized
single family dwelling.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vicin-
ity and zone in which the property is located because the variance affects an
existing front setback which would remain and which is consistent with other
development in the area and an existing side yard setback which deviates only
slightly from the zone requirement; the present setbacks have existed for
many years, and fire and other emergency access is not obstructed.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because it does not increase density.
NOW, THEREFORE, BE IT RES0LVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Conms. Currmings, Ebey, Simpson, Chmn. Sims
NOES: None
ABSENT: Comms. Beard, Toth
