HomeMy WebLinkAboutBZA Resolution 154-237 - (45 7th St)RESOLUTION B.Z.A 154-237 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 45 SEVENTH STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at public hearings held on July 18 and August 1, 1977, in the Council Chambers of the City Hall, considered the request of Mr. Ron Schendel for permission to add a second unit to an R-3 property with nonconforming side yards, lot coverage in excess of 65%, and less than the required usable open space; on property known as Lot 21, Block 8, Hermosa Beach Tract; and WHEREAS, at said public hearings, the following facts were presented for consideration; the existing lot coverage is 80% and the demolition of the existing family room and rebuilding to meet west sideyard requirement will decrease the existing lot coverage by 2%; that the proposed addition and remodel does not meet the required 400 sq. ft. of usable open space as the only open space provided will be the 212 sq. ft. of roof deck; and WHEREAS, at said public hearings, the applicant agreed to redesign the exterior stair- way to be located within the recreation room; and WHEREAS, at said public hearings, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified, subject to conditions, for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because at the time the structure was built, the lot coverage in the area co~ld be 75%, and this proposal is within that general percentage. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because there are other properties in the area with excessive lot coverage. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it does not directly affect any other property in the area. 4. That the granting of such variance will not adversely affect the comprehen- sive General Plan because it is consistent with the General Plan. AND, FURTHER, that the request is granted subject to the following condition: 1. That a deed restriction be required to insure:·the property will remain two units. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Beard, Cunmings, Simpson, Chmn. Sims NOES: None ABSENT: Comms.
