HomeMy WebLinkAboutBZA Resolution 154-238 - (1734 Prospect Ave)RESOLUTION B.Z.A. 154-238 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1734 PROSPECT AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on July 18, 1977, in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Fred G. Lee for permission to remodel an existing undev- eloped area on the first floor into additional living area, to include a second kitchen, on property known as Lot 9, Angela Heights Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration, that the property is located in an R-2 zone and has adequate square footage to be allowed two unit usage; however, the owners are unable to provide the required park- ing to be allowed a second unit; that applicant desires to enlarge the existing single dwelling, not to create a second unit; and WHEREAS, at said public hearing, the applicant stated the need for a second kitchen was due to a handicapped son, and that they would be willing to sign a deed restriction limiting the property to single family usage; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because of unusual health problems with i,n the family. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicin- ity and zone, and denied to the property in question because other properties allow wet bars which are similar to this and that this one becomes necessary in order for the family to utilize the home in which they live; 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vic- inity and zone in which the property is located because there are no density or open space ramifications. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because it maintains conformity with the General Plan. AND, FURTHER, that the variance is granted subject to the following conditions: 1. That a deed restriction be required stating that the added kitchen and its surrounding area never be used as a rental; and 2. That if the current owner should sell, the kitchen plumbing must be destroyed. NOW, THEREFORE, BE IT RESOLVED, that in view of the above fihdihg of fact, the Board of Zoning Adjustments does hereby grant the request by the following vote: AYES: Comms. Beard, Cummings, Simpson, Toth, Chmn. Sims NOES: None ABSENT: Comm.
