A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1212 OCEAN DRIVE/1017
AVIATION BOULEVARD, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at public
hearings held on July 18, August 1 and August 15, 1977, in the Council Chambers of
the City Hall, considered the request of H. K. Fenneberg and Katherine M. Kramer for
permission to be allowed to pave and fence the easterly portion of Lot 3 (1212 Ocean
Drive) to provide private off-street parking for the commercial property on Lot 1
(1017 Aviation Boulevard), legally described as Lots 1 and 3, Block 2, G. G. Allen's
Sub; and
WHEREAS, at said public hearings, the applicants stated that the situation of R-1
abutting commercial property is fairly unique in the city since there is usually a
buffer zone; that presently six employees now park on the street, and they would use
the parking lot for the employees; that there is another parking lot directly across
the street; and
WHEREAS, at said public hearings, seven residents sent letters in favor of granting
the request, and eleven residents sent letters in opposition to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified, subject to conditions, for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because it is one of the only corridors
in town where there is not a buffer zone which would allow this kind of usage
directly behind the commercial zone.
2. That the variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in ·question because it is one of the
only corridors in town where there is not a buffer zone which would allow
this kind of usage directly behind the commercial zone.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located because it will actually allev-
iate some of the existing parking problems in the area.
4. That the granting of such variance will not adversely affect the comprehen-
sive General Plan because there is no increase in density.
AND, FURTHER, that the variance is granted subject to the following conditions:
1. That the landscaping plan is to be approved by the Design Review Board.
2. That the parking lot is approved only for the life of the applicant's
business, and if the property is sold or the business terminated, the land
will revert to its original use.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Comms. Beard, Cummings, Ebey, Simpson, Chmn. Sims
NOES: None
ABSENT: Comm. Toth
