RESOLUTION B.Z.A. 154-240
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 608 FIRST STREET, HERMOSA
BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on August 1, 1977, in the Council Chambers of the City Hall, considered
the request of Mr. Fred Brown to reconsider his request to erect a single family
dwelling on R-3 property with an existing oil well on rear portion of lot, on prop-
erty known as Lot 153, Walter Ransom Co. 's Venable Place Tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that this request was previously denied by the Board on May 2, 1977, was appealed to
City Council and returned to the Board for reconsideration of the request; and
WHEREAS, at said public hearing, the applicant stated the only change in the plan
has been to move the proposed dwelling to the east side of the lot thereby providing
an 11 ft. westerly sideyard; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the condition is unique.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because otherwise there is
no way for the applicant to build until the oil well is abated.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injur~6us to the property or improvements in such vic-
inity and zone in which the property is located because the applicant has
provided a buffer area, and because the project is not injurious to the area.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because the density will be lower than that indicated
by the General Plan.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Comms. Beard, Cummings, Simpson, Chmn. Sims
NOES: None
ABSENT: Comms. Ebey, Toth
