HomeMy WebLinkAboutBZA Resolution 154-241 - (207 16th St)- RESOLUTION B.Z.A. 154-241 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 207 -16TH STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 15, 1977, in the Council Chambers of the City Hall, considered the request of Mr. Peter H. Toogood for permission to construct a 5 ft. x 14 ft. wood deck encroaching into the required west sideyard setback approximately 3 ft. and to provide less than the required corner vision clearance, on property known as the west- erly part of Lot 2, Block 50, 1st Addition to Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the request is in conflict with Section 503 (2) (b) and Section 1207 of the Zon- ing Code; that the proposed deck encroaches 3 ft. into the required 4 ft. required sideyard, leaving one ft. to property line; and WHEREAS, at said public hearing, the applicant stated that the deck will not interfere with drivers• vision as the base of the deck will be 61 above the road; that there is a four-way stop at the corner; and WHEREAS, at said public hearing, letters were submitted from seven residents of the area in favor of the request; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the property is on a four-way blvd. step corner, allowing no through vehicular traffic; and the street in question curves away from the proposed project in such a way that vision is not a problem. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because there are other properties jhich into the req~fred corner vision which actual vision is not impaired. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vic- inity and zone in which the property is located because letters from residents of surrounding properties have been received in favor of the variance. 4. That the granting of such variance will not adversely affect the comprehen- sive General Plan because there is no increase in density. AND, FURTHER, that the variance is granted subject to the following condition: 1. That no portion of the area underneath the deck may be closed in at any time during the life of the structure. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the request by the following vote: AYES: Comms. Beard, Cummings, Ebey, Simpson, Chmn. Sims NOES: None ABSENT: Comm.
