HomeMy WebLinkAboutBZA Resolution 154-242 - (563 2nd St)RESOLUTION B.Z.A. 154-242 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 563 SECOND STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 1, 1977, in the Council Chambers of the City Hall, considered the request of Mr. Douglas J. Kozakowski and Mr. Michael J. Kirby for permission to make structural alterations to an existing legal nonconforming triplex, on property known as Lot 3, Tract 451; and WHEREAS, at said public hearing, the following facts were presented for consideration; that, in January of this year, the Board granted this property legal nonconforming status as three dwelling units in an R-1 zone; that the owners of the property wish to enclose the present covered porch, thereby enlarging the living room of one unit; and to add to existing deck and refurbish existing stairs; and to add a retaining wall and two sliding glass doors; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because without a variance, the cos- metic improvements would not be allowed. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vic- inity and zone, and denied to the property in question because otherwise the applicant would not be able to bring these units up to liveable stan- dards. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the changes and alterations are mostly internal in nature and the surrounding dwellings are not effected. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because density is not increased over present usage. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Beard, Cummings, Simpson, Chmn. Sims NOES: None ABSENT: Comms.
