HomeMy WebLinkAboutBZA Resolution 154-243 - (112 19th St)RESOLUTION B.Z.A 154-243 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 112 -19TH STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 1, 1977, in the Council Chambers, City Hall, considered the request of Mr. Leslie Chikami for permission to make structural alterations to a six- unit legally nonconforming property, known as Lot 15, Block 32, 1st Addition to Her- mosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that, in October, 1974, the Planning Commission determined this property to be a legally nonconforming six dwelling units; that the owners wish to remodel one of the units to divide one bedroom into two; add two decks over existing roofs and to remodel two bath- rooms and the kitchen; and WHEREAS, at said public hearing, the applicant stated he wants the additional bedroom because he has two children, one boy and one girl; that his unit is 2,000 sq. ft. and the requirement for a five bedroom is only 1800 sq. ft.; that the present bedroom is almost 20 ft. long; and WHEREAS, at said public hearing, one resident spoke in favor of the request and two residents spoke in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified, with the exception of splitting the bedroom with a permanent structural wall, for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the property is currently a legal nonconforming use. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vic- inity and zone, and denied to the property in question because it is a legal nonconfo1rming use. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the modifica- tions are cosmetic and internal in nature. 4. That the granting of the variance will not adversely affect the compre- hensive General Plan because the alterations do not increase the density or occupant capacity of the unit. AND FURTHER, that the bedroom may hot be split into two bedrooms with a permanent structural wall because it will increase the capacity of the dwelling unit; NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Beard, Cummings, Simpson, Chmn. Sims NOES: None ABSENT: Comms.
