A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 302 -25TH STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on August 15, 1977, in the Council Chambers of the City Hall, considered
the request of Mr. and Mrs. David Baskerville for permission to add a bedroom, bath
and sitting room on second floor of existing single residence with nonconforming rear
yard setback of 4 ft. 3 in. for a distance of 13 ft. 7 in. at rear of property and a
nonconforming garage depth of 17 ft. 11 in.; and
WHEREAS, at said public hearing, the applicant stated that the existing home, as con-
structed in 1929, met all codes of that time; the rear yard lacks 9" and the garage
depth is 111 from meeting code for existing garages; that the new construction will not
be over the nonconforming area of the existing house; and
WHEREAS, at said public hearing, a petition containing 19 signatures of neighboring
residents in favor of granting the request was received; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request;
and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the vatiance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because otherwise there would be no
way the applicant could improve his property in keeping with the surround-
ing properties and the infractions are very minor in nature.
2. That the variance is necessary for the preservation and enjoyment of a sub-
stantial property right enjoyed by other property in the same vicinity and
zone, and denied to the property in question because otherwise there would
be no way the applicant could improve his property in keeping with the sur-
rounding properties and the infractions are very minor in nature.
3. That the granting of the variance will not be materially detrimental to the
public welfare or-: injurious to the property or improvements in such vicinity
and zone in which the property is located because there is a petition from
the surrounding properties indicating that they are in favor of the project.
4. That the granting of such variance will not adversely affect the comprehen-
sive General Plan because it is below the density of R-2.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Comms. Beard, Cummings, Simpson, Chmn. Sims
NOES: None
ABSENT: Comm. Toth
ABSTAIN: Comm. Ebey

I hereby certify that the foregoing Resolution BZA 154-244 was adopted by the Board of
Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 15th
day of August, 1977.
