HomeMy WebLinkAboutBZA Resolution 154-245 - (318 29th St)VARIANCE REqUEST BZA 154-245 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 318 -29TH STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 15, 1977, in the Council Chambers, City Hall, considered the request of Mr. and Mrs. Mike Seeley for pennission to add more than 40% to an existing single family residence with nonconforming easterly sideyard and noncon- forming garage depth; and to be allowed 67% lot coverage; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the applicants propose to remove a utility room and bath beside their existing one-car garage to create a second off-street parking space; that the garage spaces are 17 ft. deep, one foot short of the minimum required 18 ft; that they propose to pro- vide an interior stairway connection between the rear portion and main house, which causes them to exceed the maximum lot coverage by 2%; that the existing nonconforming sideyard of 2'411 only extends for the distance of 21 ft .. along the easterly side of the garage; and WHEREAS, at said public hearing, the applicant stated that he will not be perpetuating the existing nonconforming side yard in the new addition; that the two structures are now detached and the only additional lot coverage will be in the enclosure over the stairway; and WHEREAS, at said public hearing, one resident of the area opposed the request on the basis it will cause a view loss and take away some of his privacy; and WHEREAS, at said public hearing, a petition bearing the signatures of 16 residents of the area in support of the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the structure was originally ·built pursuant to the city requirements which have been amended over the years and thereby creating the nonconforming conditions and making it neces- sary to request a zoning variance as stated in order to construct the desired addition. 2. That the variance is necessary for the preservation and enjoyment of a sub- stantial property right possessed by other property in the same vicinity and zone, and denied .to the property in question because the 11 non-allowance 11 of structural alterations·due to certain nonconforming conditions creates a hard- ship and prevents the improvement and restoration necessary to enjoy the appli- cant's property. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicin- ity and zone in which the property is located because the proposed alterations will be an asset to the corrmunity in maintaining the original architecture, and also that although a view to the east will be lost, this is not directly due to the variance as a second floor could be built and have the same effect on the view without requiring a variance but the result would be a less desir- able structure for the city. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because the addition has no impact upon the General Plan and represents the lowest density, i.e., single family dwelling. -Continued - ,, PAGE TWO -RESOLUTION B.Z.A. 154-245 318 -29TH STREET NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the request by the following vote: AYES: Comms. Beard, Cummings, Ebey, Simpson, Chmn. Sims NOES: None ABSENT: Comm.
